To obtain warranty service or to return a defective product, the customer must first secure a Return Material Authorization (“RMA”). For every product delivery, the customer must obtain separate RMA number. A RMA number may be requested from Envoy Data Memory, Scottsdale, AZ, via e-mail HERE.
The application for a RMA number must include product identification information, including model number and serial number (if applicable) with a detailed description of the problem the customer is experiencing. The customer must also include proof of the date of original purchase as evidence that the product is within the applicable warranty period.
Within thirty (30) days after obtaining a RMA number, the customer must return the product to Envoy Data Service Center, 8444 N 90th St Ste 125 Scottsdale AZ 85258. Customer is responsible for the cost of insuring and shipping. Products shipped to the service center must be properly packaged to prevent damage in transit. The RMA number must be prominently displayed on the outside of the package. If the customer sends the product to the service center without RMA number prominently displayed on the outside of the package, it will be returned unopened.
After a period of two (2) month after the purchase of the product only technically defective products can be returned within the RMA process. Before returning a technically defective product, customer must first have given written notice of the defect within the time required by the Terms and Conditions. Blemishes, visual defects and utilization traces are excluded from warranty.
Returned products with no technical defects will be sent back at customer’s cost and a handling & inspection fee of US-Dollar 10.00 per piece will be charged. Same applies if proof of warranty was not provided or warranty period has expired.
The right to raise warranty claims expires if the customer or a third party carries out repair work or effects modifications without our prior written consent or if the customer, in the event of a defect, fails to take immediately all appropriate steps to mitigate resulting damage and grants us the opportunity to remedy such defect.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE FOREGOING IS THE COMPLETE WARRANTY FOR ENVOY MEMORY PRODUCTS AND SUPERSEDES ALL OTHER WARRANTIES AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN. EXCEPT AS EXPRESSLY SET FORTH ABOVE, NO OTHER WARRANTIES ARE MADE WITH RESPECT TO ENVOY MEMORY PRODUCTS AND ENVOY MEMORY EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED HEREIN, INCLUDING ANY WARRANTY IMPLIED BY LAW INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, ARE LIMITED TO THE PERIODS OF TIME SET FORTH ABOVE.
ENVOY MEMORY PRODUCTS ARE NOT AUTHORIZED FOR USE AS CRITICAL COMPONENTS IN LIFE SUPPORT EQUIPMENT OR FOR APPLICATIONS IN WHICH THE FAILURE OR MALFUNCTION OF THE PRODUCTS WOULD CREATE A SITUATION IN WHICH PERSONAL INJURY OR DEATH IS LIKELY TO OCCUR. ENVOY MEMORY SHALL NOT BE LIABLE FOR THE DEATH OF ANY PERSON OR ANY LOSS, INJURY OR DAMAGE TO PERSONS OR PROPERTY BY USE OF PRODUCTS USED IN APPLICATIONS INCLUDING, BUT NOT LIMITED TO, MILITARY OR MILITARY-RELATED EQUIPMENT, TRAFFIC CONTROL EQUIPMENT, DISASTER PREVENTION SYSTEMS AND MEDICAL OR MEDICAL-RELATED EQUIPMENT.
ENVOY MEMORY’S TOTAL LIABILITY UNDER THIS OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED, IS LIMITED TO REPAIR, REPLACEMENT OR REFUND. REPAIR, REPLACEMENT OR REFUND ARE THE SOLE AND EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY OR ANY OTHER LEGAL THEORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ENOVY MEMORY SHALL NOT BE LIABLE TO THE PURCHASER OR END USER CUSTOMER OF AN ENVOY MEMORY PRODUCT FOR ANY DAMAGES, EXPENSES, LOST DATA, LOST REVENUES, LOST SAVINGS, LOST PROFITS, OR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE PURCHASE, USE OR INABILITY TO USE THE ENVOY MEMORY PRODUCT, EVEN IF RUGGED, INDUSTRIAL GRADE AND MILITARY ENVOY MEMORY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
